Recruiter Terms Draft for legal review
1. Who we are
Turbomachinery Community is an online technical community for turbomachinery professionals, operated by Lightbulb Waves LLC. It is a technical knowledge network, not an employment agency, staffing firm, recruitment business, employer, hiring platform or job board.
2. Who must register as a recruiter
Anyone who uses the Community to approach members for employment, contract, freelance or other work, for themselves, their employer or a client. Recruitment from a professional account is not allowed.
3. Registration and identification
Recruiters tick “I am a recruiter”, give their recruiting company, confirm a work email address at that company’s domain and accept these terms. Recruiter accounts carry a visible Recruiter label, shown with the company on the profile and with every message. Accounts are personal and may not be shared.
4. Limited checks
We check only that the recruiter controls the work email address given. We do not verify recruiters’ identity, licences, vacancies or offers, and we do not verify or guarantee member profiles, qualifications or suitability for any role. References, right-to-work and background checks are the recruiter’s responsibility.
5. Independence and no involvement
We are not tied to or acting for any recruiter, employer or client. We do not publish vacancies, accept recruitment advertising, screen, shortlist, recommend or introduce candidates, or take part in interviews, offers, contracts or onboarding. We are not a party to any contact, offer or agreement between recruiters and members and are not responsible for its outcome.
6. Subscription fee
The recruiter fee pays only for access to Community features for the subscription period. It is not a placement, finder’s or success fee or commission, and does not depend on any member being contacted or hired. Members are never charged, and recruiters must not charge members any fee.
7. How recruiters may contact members
By private message only, and only to members who accept recruiter messages. Members can change this setting, decline, ignore or report any message. No recruitment posts in public areas, no bulk or automated messaging, no copying or exporting member data, no contact outside the Community without the member’s agreement, no misrepresentation and no unlawful discrimination.
8. Recruiter obligations
Recruiters are solely responsible for complying with the laws that apply to them, including employment, recruitment-agency licensing, equal opportunity, immigration, data protection and electronic-communication laws. Member data kept outside the Community is the recruiter’s own responsibility.
9. Liability and indemnity
The Community is provided “as is”. To the maximum extent permitted by law, we are not liable for any loss arising from dealings between recruiters and members, and our total liability is limited to the fees paid in the previous [12] months. Recruiters indemnify Lightbulb Waves LLC against claims arising from their recruitment activities or breach of these terms.
10. Suspension, changes and law
We may remove content and suspend or close recruiter accounts that breach these terms. Recruiters may cancel at any time, effective at the end of the billing period. Material changes are notified at least [30] days in advance. Governing law: [to be confirmed].
